BOOKING

NON-REFUNDABLE AND NON-TRANSFERABLE BOOKING FEE
1. The CLIENT shall pay the full amount that will also serve as the booking fee to block the date and time.
2. The Client will be asked to pay the full amount upon signing the Booking Form. The STVDIO shall approve the reservation once the deposit is made, and the agreement is signed. The payment shall also serve as a cancellation fee.


PAYMENTS
1. Modes of payment include bank transfers, PayPal, and GCash. All payment details are available on the website and may also be sent to the client via SMS or messaging applications.

 

STVDIO PACKAGES
1. All details about the photoshoot should be discussed at least three (3) days before the actual session.
These include the background colour(s), lighting or photo style requests, and poses.

2. If the Client fails to discuss these details with the Photographer, the Photographer shall decide on the
backdrop color and style. No changes should be made by the Client during the session.

3. If the Client wishes to change the style during the actual shoot, this may incur a fee amounting to
Php1,000. The Photographer will not be held liable for the Client’s loss in session time as a result of
changing the layout and style.

About your photo session

LIMITED LIABILITY
1. In the unlikely event that the photographer fails to provide the contracted services due to unforeseen circumstances, the liability is limited to the return of all payments received within five (5) days of the scheduled event. This limitation on liability shall also apply if the photographic materials are lost, damaged during post-processing, or media malfunction without fault on the part of the photographer.

2. The photographer may recommend other professionals in the industry who can fulfill the photo
coverage obligations on his behalf. The client will have to coordinate with the new photographer for a
separate service agreement.


CANCELLATION AND RESCHEDULING
1. Should the client decide to cancel the service agreement for whatever reason, the photographer shall
treat the booking fee as a cancellation fee.
2. Cancellation must be made in writing and signed by the contracted parties. It must be sent to the photographer via email at least three days prior to the date of the event/photo session. If the Client

fails to inform the Photographer within this given time frame, the contract will be automatically cancelled.
3. Rebooking of services is allowed. If the client wishes to have the photo session rescheduled, granted that he/she informs the Photographer about rescheduling the photo session at least three days before the actual shoot, the previous contract will be cancelled, and a new service agreement shall be provided by the Photographer. The client shall pay a 25% rescheduling fee upon signing the new contract.
4. Rescheduling a photo session can only be done twice. The rescheduling fee will be forfeited otherwise.

 

ATTENDANCE
1. Clients should arrive at the photoshoot, dressed (including hair and makeup if needed) and ready to shoot.

 

DELAYS AND NO-SHOW
1. The Client understands that sessions are booked based on the Photographer’s schedule and availability. In the case that the Client arrives late, the contract time shall still be followed, and the Photographer will not be held liable for the Client’s loss in session time.
2. If the Client does not show up at the agreed time and venue, completely missing the entire booked session without any notice, the service agreement will be cancelled and the reservation fee will be forfeited.
3. The service agreement will still also be cancelled if the Client fails to show up within the first 30 minutes of the booked session, forfeiting the reservation fee payment.
4. In the event that the Client reports a health issue resulting in the cancellation of the session, he/she shall inform the Photographer and present a proof of illness and/or injury. The Client shall pay 25% of the total contract amount as rescheduling fee should he/she decide to move the photo session to a later date.

After your photo session

RETENTION POLICY
1. All enhanced images will be made available within 21 business days.
2. A maximum of 60-day access to the online gallery will be provided to the client. All images will be deleted after 60 days.
3. In the event that the client wishes to obtain a copy of the enhanced digital images using his/her personal external hard drive, the client should inform the Photographer within the 60-day retention period. The device shall be sent to the Photographer. All related shipping fees shall be shouldered by the Client.


IMAGES AND POST-PROCESSING
1. Client accepts that all photographs will be taken and edited at the photographer’s discretion based on the photographer’s experience and artistic view. If the Client has special requests, he/she shall create a “shot list” of all images that he/she requires.
2. All deliverable images as per contract will have standard image editing (including: cropping, colour grading, light skin retouch, and other basic adjustments). Any extra edits requested by the client will cost the client Php250 per image if accepted by the Photographer. Extra image adjustments include but are not limited to adjusting the size of a body part, extra skin retouch, enhancing makeup color, and replacing the background.

Weather condition

1. All outdoor sessions are dependent on weather conditions. The Client shall not force the Photographer to use his equipment if he deems the weather to be unsuitable for an outdoor shoot session.
2. In case of a bad weather, the photo session shall be rescheduled based on the Photographer’s availability with no additional charge. If it rains in the middle of the photoshoot, the session will still be rescheduled granted that the consumed time is less than 50% of the contract time.

Indemnity

1. The Client shall fully indemnify the Photographer in the event of any loss or damage to the fixtures, fittings or any parts of the Studio or any equipment, items, property of the Studio caused by the Client or any person accompanying the Client during the shoot.

Use & Reproduction

1. The Photographer owns the copyright to the published photos unless there is a stipulation in the service
contract.
2. All images and other photographic materials shall be treated as an exclusive property of the
Photographer. The Photographer shall own the copyright in all images created and may use the work
for samples, contests, exhibition, advertising and self-promotion. Use of the said materials outside the
bounds of this agreement will require the Client’s consent.
3. The Client releases the Stvdio and the Photographer from all claims and liability relating to the
published images, UNLESS the Client has made a request for privacy or censorship prior to the Shoot.
This request must be made in writing, signed by the contracted parties and sent to the Photographer

via email. In this event, the Photographer may not use such photos of the Client for publicity,
promotion, or presentation purposes.
4. The Client’s right to use the images comes into effect once full payment is made.
5. A description of the intended usage and purpose of images must be disclosed upon booking the
service.
6. In the event that the Client alters the images including the application of filters, editing, cropping, adding
text without permission, that may result in reputational damage, the Photographer has the right to
request for the deletion of these published images.
7. Images must not be given to other service providers (e.g., makeup artists, lights and sounds team, etc.)
without the Photographer’s permission.
8. If the Client decides to publish the images online, it is required that citation of the photographer be
included in the caption. The Photographer has the right to request for the image deletion if the Client
fails to comply.
